These Terms of Service ("Terms") govern your access to and use of the BusinessMailer platform ("Service") operated at businessmailer.org. By creating an account you agree to these Terms.
1. Acceptable use
You agree to use the Service only for lawful business communications with recipients who have a legitimate expectation of hearing from you. You are responsible for the content of every email you send and for complying with all applicable laws, including anti-spam legislation (CAN-SPAM, GDPR, CASL, and equivalent laws in your jurisdiction).
2. Prohibited content
You may not use BusinessMailer to send messages that:
- Impersonate any person or brand you are not authorized to represent.
- Promote cryptocurrency schemes, gambling, adult content, illegal goods, pyramid or MLM offers, or "get-rich-quick" programs.
- Contain malware, phishing links, credential-harvesting forms, or misleading subject lines.
- Harass, threaten, defame, or discriminate against any person or group.
- Are sent to purchased, scraped or rented address lists.
3. Account responsibilities
You are responsible for keeping your password secure, for all activity under your account, and for the accuracy of the information you provide. You must be at least 18 years old to create an account. One person or legal entity per account.
4. Subscription terms
Access to the Email Builder requires an active subscription of ₦5,000 per 4-week period. Subscriptions are billed through Paystack and do not auto-renew — you must repurchase to continue sending after the period ends. Optional add-ons (email top-ups, premium sender ownership) are billed separately.
5. Email sending limits
Active subscribers may send up to 6 branded emails per 24 hours. If you exhaust your daily quota you may purchase a top-up of an additional 6 emails for ₦3,000; top-ups expire after 24 hours. We may adjust these limits at any time to protect deliverability for all users. Attempts to circumvent the limits (multiple accounts, automation, etc.) may result in suspension.
6. Connected email accounts
If you connect a personal Gmail or SMTP account to send from your own address, you are solely responsible for that account and for compliance with your provider's terms. BusinessMailer only holds a scoped credential that lets us send messages you explicitly initiate.
7. AI assistants
When you connect an AI assistant, any action the assistant takes on your account (sending an email, creating a sender, etc.) is treated as an action you took. Review the AI Activity log regularly and revoke access if you no longer use the integration.
8. Suspension and termination
We may suspend or terminate your account without notice if we detect abuse, prohibited content, chargebacks, or violation of these Terms. You may terminate your account at any time from the profile page.
9. Liability disclaimer
The Service is provided "as is" without warranties of any kind. We do not guarantee inbox placement, uptime, or specific delivery outcomes. To the maximum extent permitted by law, BusinessMailer will not be liable for indirect, incidental, or consequential damages, and total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.
10. Refund policy
Subscription and top-up payments are non-refundable once emails have been sent against the allotment. If a payment is charged but access is not granted due to a technical fault on our side, contact us within 7 days for a full refund.
11. Changes to the Service
We may add, change, or remove features at any time. We will make a reasonable effort to notify you of material changes in advance.
12. Governing law
These Terms are governed by the laws of the Federal Republic of Nigeria. Any dispute will be resolved in the courts of Lagos, Nigeria.
